MAFA HI Lawsuit against Freedom of Movement

By and through our local attorney, Sierra Hägg,  and acting on behalf of Make Americans Free Again as the Hawaii Chapter, along with 8 other plaintiffs, we filed a civil complaint in the Federal District Court for the District of Hawai’i against Governor David Y. Ige, Kaua’i Mayor Derek S.K. Kawakami and the County of Kaua’i. This lawsuit brought claims of violations to the plaintiffs rights to due process, freedom of movement, religious rights and equal protection under the First, Fourth and Fourteenth Amendments of the United States Constitution. These rights were violated as a result of the governor and mayor’s rules and regulations related to the Covid-19 Emergency. This lawsuit set out to expose the fact that there never was a true emergency to begin with and irregardless, our rights must not be violated beyond what is essential to handle said emergency. Of course such rights violations must be justified and regulations must be narrowly tailored. Two things that were never evident.

Over a year later this lawsuit is still pending and in fact cannot simply be dismissed without forcing the 9th Circuit Court to reverse prior decisions made in relation to the quarantine of healthy people. In the 1900’s there were two cases heard in this circuit where it was decided that overly broad quarantine regulations were unjustifiable under the constituion of the United States of America.

A Rule 16 Hearing is set for May 11, 2023 in order to move forward in the process of hearing this case.
